Terms of Service

These Terms of Service form the agreement between you and CarCare Digital for the use of carcaredigital.com and our applications. By creating an account or using the service, you accept them.
If you use the service on behalf of a workshop, dealer, rental company, or fleet, you confirm that you are authorised to accept these Terms for that organisation.
1. The service
CarCare Digital provides a digital vehicle service book and vehicle passport, expense and fuel tracking, maintenance reminders, an AI assistant, PDF reporting, business tools for workshops and fleets, and a vehicle marketplace. We develop the product continuously. Features may be added, changed, or withdrawn. Where a feature is experimental or incomplete, we label it in the product rather than presenting it as finished.
2. Eligibility and your account
You must be able to enter into a binding contract in your jurisdiction. You agree to provide accurate registration details and to keep them current. You are responsible for your credentials and for activity under your account. Administrators are strongly encouraged to enable two-factor authentication. Tell us promptly if you suspect unauthorised access. We may suspend or close accounts that are inactive for an extended period, that were created with false details, or that breach these Terms.
3. Plans, pricing, and billing
We offer a Free plan and paid plans: Plus and Pro for private drivers, and Business for workshops, dealers, rental companies, and fleets. Plan limits — such as vehicle count, AI usage, storage, and PDF export — are shown on the pricing page and enforced in the product. Paid plans are billed in advance for each billing period through our payment processor. Prices are stated in euro and may be shown excluding or including tax depending on your location and the processor's rules. Subscriptions renew automatically for the same period until cancelled. Where we offer manual or crypto activation, access is granted for a fixed term and does not renew automatically; when it expires the account returns to Free. We may change prices for future billing periods. We will give you reasonable advance notice, and you may cancel before the change takes effect.
4. Cancellation and withdrawal
You may cancel renewal at any time from Billing in your account, including through the payment processor's customer portal. Cancellation stops future charges; access to paid features continues until the end of the period you have already paid for. Consumers in the EU and EEA have a statutory right of withdrawal for distance contracts. Because paid features are made available immediately, that right may be limited once performance has begun with your express consent. Refunds, prorating, and the exact withdrawal process are described in our Refund & Cancellation Policy, which forms part of these Terms.
5. Acceptable use
You agree not to: • upload unlawful, infringing, or deliberately false content • enter service records or listings you know to be inaccurate, or misrepresent a vehicle's history • attempt unauthorised access, probe or disrupt the platform, or circumvent quotas, rate limits, or plan restrictions • scrape, resell, or systematically extract data from the service without written permission • use messaging or communication features to send unsolicited bulk messages • impersonate another person, workshop, or business We may suspend or terminate access for conduct that harms the platform, other users, or the integrity of vehicle records.
6. Your content and the licence you grant us
You keep all rights to the data, documents, and images you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and process that content solely to operate and improve the service for you — for example generating passports, reports, reminders, and assistant answers. You confirm that you have the rights necessary to upload the content and to share it through the features you enable. You control publication of a vehicle passport and can unpublish it at any time.
7. Workshop-confirmed records and the marketplace
Workshops publishing records to a customer's vehicle warrant that the work described was actually performed and that the details are accurate. Linking a workshop record to an owner's vehicle requires the owner's consent. Marketplace trust tiers describe the evidence attached to a listing, not a guarantee of a vehicle's condition. A verified or certified label means specific checks were recorded, not that the vehicle is defect-free. Transactions between buyers and sellers are concluded directly between them. We are not a party to the sale, do not act as an agent or escrow, and do not warrant the accuracy of user-submitted listing content.
8. AI assistant
The assistant produces informational guidance based on your records and general automotive knowledge. It can be incomplete or wrong. It is not a substitute for inspection or advice by a qualified mechanic, and it must not be relied on for safety-critical decisions. Always have suspected faults examined professionally. AI usage is subject to the quotas of your plan.
9. Availability and support
We work to keep the service available and to keep your data safe, and we operate regular backups. We do not, however, guarantee uninterrupted or error-free operation on the Free plan or in the absence of a separate service-level agreement. Maintenance, third-party outages, and factors outside our control may cause interruptions. Support is provided by email, normally with a response within one to two business days.
10. Third-party services
The service integrates third-party providers, including payment processing, email delivery, messaging channels, AI providers, and infrastructure. Your use of those features is also subject to the relevant provider's terms. We are not responsible for the acts, omissions, or outages of third-party providers beyond our reasonable control.
11. Intellectual property
The platform, including its software, design, brand, and documentation, belongs to CarCare Digital and its licensors. These Terms grant you a limited, revocable, non-transferable right to use the service, and no rights to our source code, trade marks, or design beyond that use.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided “as is” and “as available”, without implied warranties of merchantability or fitness for a particular purpose. We are not liable for indirect or consequential loss, lost profits, lost sale value, or loss of data beyond our statutory responsibility. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability for intent, gross negligence, personal injury, or any liability that cannot be limited under applicable law. Mandatory consumer rights are unaffected.
13. Suspension and termination
You may stop using the service and request account deletion at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or if your use threatens the security or integrity of the platform. On termination, paid access ends and we handle your data as described in the Privacy Policy. We recommend exporting your records before requesting deletion.
14. Changes to these Terms
We may update these Terms as the product and legal requirements change. The date at the top reflects the current version. For material changes we will provide reasonable notice in the product or by email. Continued use after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the law of our place of establishment, without prejudice to mandatory consumer protection rules of your country of residence, which continue to apply to you as a consumer. Before starting formal proceedings, please contact us so we can try to resolve the matter directly. Most disputes are billing or account issues that we can settle by email.
